NTIA Announces Next Meetings

The National Telecommunications and Information Administration has announced the next two meetings of its multistakeholder process to develop an industry code of conduct for how consumer data is handles in mobile apps.  The meetings will be held on August 22 and 29.  AAF was among the hundreds of stakeholders who participated in the initial meeting on July 12.  That meeting resulted in a list of issues, or elements, that may be addressed in the code.  Participants were unscientifically polled in an effort to roughly prioritize the issues.  The focus of the next meetings will reportedly be on “transparency.”

FTC To Look Further at Children’s Online Privacy

The Federal Trade Commission has announced that it has published a Supplemental Notice of Proposed Rulemaking for possible modifications to the Rule implementing the Children’s Online Privacy Protection Act (COPPA).  The notice proposes additional modifications to the COPPA Rule’s definitions of “operator,” “personal information,”  “screen name,” “support for internal operations,” and “website or online service directed to children.”  The proposals would make it more explicit that third parties collecting data would also be covered by the rule.

Cybersecurity Measure May Become Vehicle for Unrelated Privacy Issues

The U.S. Senate will not take up Cybersecurity legislation before its August recess.  AAF learned that some Senators intended to offer amendments that would have add unrelated data security, data breach and/or commercial privacy provisions to the bill.  Without commenting on the underlying legislation, AAF and allied associations have written to Senate leaders urging them not to allow these amendments to be added to the bill if and when it is considered.  The industry is already working with lawmakers to find solutions to these important and complicated issues.  Those efforts should be allowed to proceed so a consensus can be found before moving ahead with legislation.  AAF believes the issues are important and complicated enough that they should be debated on their own and not tacked on to other pieces of legislation.

AAF Opposed Restrictions on College Advertising

The Advertising Coalition, of which AAF is a founding member, has written to Congressman Denny Rehberg, D-Mont., chairman of the Appropriations Subcommittee on Labor, Health and Human Services, Education, and Related Agencies urging him to oppose any amendment to bar advertising by for profit and nonprofit colleges to recruit students if the funds were derived from federal loans and grants.  A similar amendment had been attached to companion legislation in the Senate Appropriations Committee.  TAC wrote Senate Majority Leader Harry Reid, D-Nev., urging him to oppose the provision.  The Senate appropriations bill is currently stalled because of other unrelated matters.
